This General Release of Liability and Hold Harmless Agreement (this “Agreement”) is executed by the person paying for this class.  In consideration of student being granted permission to enter upon, inspect, view, and/or tour the site of the Detroit Training Center and all affiliated locations (the “Site”) the mutual covenants and agreements contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, it is agreed as follows:

1.1. Student, for (themself/himself/herself) and on behalf of (their/his/her) heirs, executors, administrators, successors and assigns, does hereby fully and forever release, acquit, and discharge Detroit Training Center, its subcontractors, affiliated companies, officers, agents, employees, assigns, and property owner of and from any and all claims, demands, liabilities, loss, damage, expense, right or cause of action of whatever kind or nature, (specifically including, without limitation, such claims caused by or arising out of the above described entity or person’s negligence or fault) and including, without limitation, all claims, demands, liabilities, loss, damage, expense, right or cause of action for personal injury to me, death to me, or damage to any of my personal property arising in any way out of student’s entry or presence upon the site of the above identified Site. I hereby acknowledge that I am aware of, understand, and appreciate the risks inherent in my presence at the Site.

1.2. Student further agrees, for (theirself/himself/herself) and on behalf of (theirs/his/her) heirs, executors, administrators, successors and assigns, to indemnify, defend and hold harmless Detroit Training Center, Inc., its subcontractors, affiliated companies, officers, agents, employees, assigns, and property owner of and from any and all claims, demands, liabilities, loss, damage, expense (including attorney’s fees), right or cause of action of whatever kind or nature, from third-parties or otherwise, which in any manner may arise or be alleged to have arisen, or resulted, or be alleged to have resulted, from the presence or activities of student on the Site of facility identified above, (specifically including, without limitation, claims of negligence or fault) and including, without limitation, all claims, demands, liabilities, loss, damage, expense, right or cause of action, for personal injury, death, or damage to any property.

1.3. Student further acknowledges that COVID-19 infections have been confirmed throughout the United States, including in Michigan and that contraction and spreading of COVID-19 is among the risks inherent in participating in the training program offered by Detroit Training Center (collectively, “Activities”). COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

1.4. Detroit Training Center cannot prevent participants from becoming exposed to,contracting, or spreading COVID-19 while participating in Activities. If a student chooses to participate in Activities, student may be exposing (themself/himself/herself) and others to and/or increasing the collective risk of contracting or spreading COVID-19.

1.5. To mitigate the risk of COVID-19 infection, Student agrees not to participate in Activities if (they/he/she) is (i) experiencing symptoms of COVID-19, including without limitation, fever, cough or shortness of breath, (ii) has a suspected or confirmed case of COVID-19, (iii) has recently been exposed to someone with a suspected or confirmed case of COVID-19, or (iv) CDC, state or local health department guidance or protocols requires or recommends that student stays at home or self-quarantine due to recent travel or exposure risk.  Student is responsible for staying informed of and acting upon applicable public health guidance relative to reducing (their/his/her) risk of contracting and transmitting COVID-19 while participating in Activities. Student further agrees to abide by all health protocols established by Detroit Training Center.

1.6 I further state that I accept full responsibility for my safety and agree to fully comply

with all safety rules and regulations indicated by the staff, faculty, and the Occupational

Health and Safety Administration while on the Site.

1.7 I further agree that as an student I am not to be considered an employee or contractor of Detroit Training Center, and understand that I will not be covered under Workers Compensation Insurance as a result and that any medical expenses that arise out of any incident will be my responsibility and not the responsibility of Detroit Training Center.  Also as a student I will not be eligible for compensation. 

1.8 I understand that this relationship can be terminated at any time by either party.
